Salary allowance and maids: are you entitled?

Although it is not a really pleasant answer for these workers, domestic workers are not entitled to the allowance.

In practice, the salary bonus is a benefit paid every year to those who are enrolled in the PIS/Pasep.

Another requirement is that the registration must be five years old or more and that in the base year, it has at least 30 days registered in the portfolio.

For example, to receive in the year 2019, the base year is 2018.

This amount is paid by the Federal Government and many call it the 14th salary, aimed at those with a lower income.

Therefore, domestic servants do not receive the allowance because they are not registered by a legal entity, such as a company.

The same rule applies to other jobs, such as day laborers and young apprentices.

Finally, domestic workers have their own law, Complementary Law 150/2015, which guarantees several rights that are similar to other workers.

An example of this is unemployment insurance, which has already been achieved by this class.

Other works

A common doubt that arises when it comes to the salary bonus for domestic workers is the relationship with the PIS.

Therefore, PIS refers to a tax that companies pay monthly.

In this case, you are entitled to the allowance due to the registration of those five months.

An easy way to understand this is to always think about the registration: if it is done by a company or legal entity, you are entitled. Otherwise, you will not receive the allowance.

Maid job relationship

The employment relationship of domestic servants is from individual to individual.

Thus, a person or family hires the professional to carry out the activities.

Therefore, the allowance is not a benefit because there is no business relationship.

Salary allowance 2022 - Values and calendar

It is worth noting that the base year for those who will receive this year refers to 2020, that is, if you worked for 30 days or more with a work permit, you are entitled.

In this scenario, the calendar follows the birth month. But it is possible that some payment is late.

  • Born between January and June: receive from February 8;
  • Born between July and December: receive from March 15.

All payments can be made until December 29th.

Regarding the values, the calculation always considers 1/12 of the minimum wage on the payment date and the number of months worked.

For example, if you worked the entire year of 2020, which is the base year of 2022, you will receive a full minimum wage, which is R$ 1,212.

Workers who worked less time, such as one month, will receive R$ 101.
